Privacy Policy

1. Personal data we collect

We collect the personal data you provide through the contact form on cervel.net: name, email address, phone number and the information you include in your message. Along with the form we also receive the page through which you entered this site and the site you came from (for example, a search engine), so we know which content brings us inquiries; if you message us on WhatsApp from a button on the site, those two pieces of data are added at the end of the pre-filled message, where you can see and delete them before sending it. We do not collect sensitive personal data.

2. Purposes of processing

Your personal data is used for the following primary and necessary purposes: (i) to handle and follow up on the inquiries and requests you send us; (ii) to communicate with you; and (iii) where applicable, to formalize and provide the legal services you request.

Secondary purpose, not necessary to assist you: knowing which page you entered this site through and which site you came from when you write to us, so we know which content brings us inquiries. You can refuse it with the “Turn off analytics” button in the cookie notice or with your browser’s Global Privacy Control signal, and refusing does not affect the assistance you receive.

Beyond that, we do not use your data for other secondary purposes such as marketing or advertising.

3. ARCO rights and withdrawal of consent

You have the right to Access your personal data, Rectify it when inaccurate, Cancel it when you believe it is no longer needed for the stated purposes, and Object to its processing (ARCO rights), as well as to withdraw any consent you have given.

Under Article 29 of the LFPDPPP, the person designated to handle your requests is the Controller himself, Claudio César Cerón López, who attends to them at claudio.ceron@cervel.net.

To exercise any of these rights, send a request to claudio.ceron@cervel.net with the subject line “Derechos ARCO” or, to withdraw your consent, “Revocación del consentimiento”, stating your name, the data concerned and a clear description of your request or, if you are withdrawing consent, which consent you withdraw and for which processing. We will communicate our response within a maximum of 20 days from receipt of your request and, if it is granted, give effect to it within the following 15 days; both periods may be extended once for an equal period when the circumstances justify it (Article 31 of the LFPDPPP).

If you request access, we will provide your data as electronic documents sent to the email address you indicate or, if you so request, as plain copies at our offices, once your identity (or that of your representative) has been verified (Articles 31 and 32 of the LFPDPPP).

Withdrawal of consent follows the same procedure and timeframes and has no retroactive effect (Article 7 of the LFPDPPP). If you withdraw consent for a purpose that is necessary for the service, we may be unable to keep providing it, and we will retain any data the law requires us to keep.

4. Use of cookies and tracking technologies

The site cervel.net uses usage-measurement tools: Google Analytics 4 and Microsoft Clarity (the latter providing heatmaps and recordings of how the pages are browsed). Google Analytics 4 is active by default under the tacit consent that the LFPDPPP allows for non-sensitive data; Microsoft Clarity, by contrast, does not load until you accept it in the notice. We inform you through a notice visible on your first visit, and you can turn analytics off at any time from that notice or from the permanent button on our Cookie Policy; if you do not accept, if you decline, or if you turn analytics off, Microsoft Clarity does not load in your browser. Form fields are always masked and their content is not recorded. The page through which you entered and the site you came from are kept in your browser’s session storage, are deleted when you close the tab and are not stored if you turn analytics off or if your browser sends the Global Privacy Control signal. We do not run personalized advertising and do not share your data with advertisers, and if your browser sends the Global Privacy Control signal, we honor it and none of these tools are activated. 5. Data transfers

We do not transfer your personal data to third parties without your consent, except in the cases provided for in Article 36 of the LFPDPPP (for example, when the transfer is required by law or to fulfil obligations arising from a legal relationship with you).

The technology providers that serve us (such as site hosting) process the data on our behalf and according to our instructions.

To measure how the site is used, we use Google Analytics (by Google) and Microsoft Clarity (by Microsoft). Those providers may also use the browsing data they collect under their own privacy notices, so we do not count them among the providers that process data on our behalf.

6. Changes to this Privacy Policy

We reserve the right to amend this Privacy Policy. Any change will be published at cervel.net. We recommend that you review it periodically.

If we ever wish to process your data for a purpose other than those set out in this Policy, we will first ask for your consent again, as Article 11 of the LFPDPPP requires.
